Terms of Service

1 Purpose

These Terms of Service ("Terms") govern access to and use of the Famylio platform, operated by MOLDEREZ-CONSULT SRL, a Belgian private limited company registered under number BE 0842.262.084, with its registered office at Square Valère-Gille, 13 box 5, 1050 Ixelles, Belgium.

Use of the platform constitutes full acceptance of these Terms. If you do not accept these Terms, you must immediately stop using the platform.

These Terms are subject to Belgian law, including the Belgian Economic Code (Articles VI.1 et seq.) and Directive 2011/83/EU on consumer rights.

2 Definitions

"Platform": the Famylio website, mobile app and all associated services.
"User": any adult natural person who creates an account.
"Consumer": any natural person acting for non-professional purposes.
"Family": the collaborative space created by a User.
"Member": any person added to a Family space, including minors under parental responsibility.
"Content": all data, texts, images and files uploaded by Users.
"MOLDEREZ-CONSULT" or "We": MOLDEREZ-CONSULT SRL, platform operator and service provider.

3 Platform Access

Access is restricted to adults aged 18 or over. In Belgium, majority is set at 18 years per the Belgian Civil Code (Article 388). Minors may be added as members under the exclusive legal responsibility of the adult User. Registration is free for the trial period (14 days). Full access thereafter requires a paid subscription per Belgian Economic Code Articles VI.1 et seq.

The User agrees to provide accurate information during registration and maintain it current. MOLDEREZ-CONSULT reserves the right to suspend or terminate any account for inaccurate, fraudulent, or falsified information.

4 Subscriptions and Pricing

Starter plan: €19.77 incl. VAT/month — up to 4 members, essential modules.
Family plan: €59.77 incl. VAT/month — unlimited members, all available modules.

Prices are in euros including Belgian VAT (21%). Monthly billing in arrears by automatic debit. An invoice will be issued for each billing period.

MOLDEREZ-CONSULT reserves the right to modify pricing with at least 30 days prior notice, per Belgian Economic Code Article VI.52. Users may cancel free of charge if they reject the price change prior to its effective date.

5 Right of Withdrawal

In accordance with Directive 2011/83/EU and Belgian Economic Code Articles VI.51-VI.68, any consumer entering into a distance service contract has fourteen (14) calendar days to withdraw without charge or justification.

This period begins on the date of contract conclusion. Withdrawal must be notified in writing to MOLDEREZ-CONSULT at support@famylio.com or by mail to Square Valère-Gille, 13 box 5, 1050 Ixelles.

Exception: Per Belgian Economic Code Article VI.53, the right of withdrawal does not apply to the execution of digital services provided immediately and consumed upon delivery (streaming, cloud storage, immediate feature access). Stored data and configurations constitute immediate service execution and cannot be refunded after acceptance.

6 Cancellation

By the User: at any time from the account settings, free of charge, effective at the end of the current billing period. No pro-rata refunds for remaining days of paid periods.
By MOLDEREZ-CONSULT: in case of material breach of these Terms, persistent non-payment (after written notice), unlawful conduct, or unauthorized commercial use — with 7 days prior written notice except in urgent cases.

Upon termination, access ends immediately. Data is retained for 30 days then permanently deleted unless legally required otherwise.

7 Ownership of Content

Users retain full intellectual property rights to their uploaded Content. MOLDEREZ-CONSULT claims no intellectual property rights over User Content. Users grant MOLDEREZ-CONSULT a limited, non-exclusive, free, and revocable technical licence strictly necessary to provide the service (storage, display, backup, processing, and requested features).

Intellectual property rights to the platform code, design, and features remain the exclusive property of MOLDEREZ-CONSULT.

8 Acceptable Use

Users agree to use the platform only for family and collaborative purposes. The following uses are strictly prohibited:

— Commercial exploitation, resale, or unauthorized copying of the platform;
— Web scraping, bulk data extraction, or bot use without consent;
— Reverse engineering, decompilation, or unauthorized system access;
— Hateful, racist, defamatory, or harassing content;
— Child exploitation or child sexual abuse material;
— DDoS attacks, SQL injection, or malware;
— Harassment, threats, or privacy violations toward other users;
— Infringement of third-party intellectual property rights.

MOLDEREZ-CONSULT reserves the right to implement rate limiting and apply corrective measures for detected abuse.

9 User Obligations

Users agree to: use the platform lawfully per Belgian and EU law; not share login credentials and keep passwords confidential; not upload unlawful content (hateful, defamatory, infringing, privacy-violating, or containing malware); not attempt to circumvent security measures; accept full responsibility for minor members under their supervision; immediately notify MOLDEREZ-CONSULT of unauthorized account access.

10 Availability and Warranties

MOLDEREZ-CONSULT endeavours to maintain 24/7 availability and 99.5% monthly uptime but cannot guarantee uninterrupted service. Maintenance may occur for security and updates, with at least 72 hours notice when planned.

The platform is provided "as is". MOLDEREZ-CONSULT does not warrant that it will meet all specific expectations or function without errors.

11 Limitation of Liability

To the extent permitted by Belgian law and Directive (EU) 2019/771, MOLDEREZ-CONSULT shall not be liable for indirect, immaterial, or consequential damages (data loss, lost profits, business interruption). Total liability is capped at amounts paid in the preceding 12 months or €100, whichever is greater.

This does not apply to gross negligence, fraud, willful breach, or mandatory consumer warranties under Belgian law.

12 Force Majeure

Neither party is liable for non-performance due to force majeure events (natural disasters, war, terrorism, epidemics, national power outages, telecommunications failures beyond reasonable control). MOLDEREZ-CONSULT will notify Users promptly and resume service without undue delay. If interruption exceeds 30 consecutive days, Users may cancel free of charge.

13 Data Protection

MOLDEREZ-CONSULT collects and processes personal data in accordance with Regulation (EU) 2016/679 (GDPR) and Belgian law dated 30 July 2018 on personal data protection. For full details on data collection, use, storage, sharing, and user rights, please see our Privacy Policy at /privacy.php.

Users have rights of access, rectification, erasure, and data portability under GDPR Articles 15-20.

14 Dispute Resolution and Mediation

In case of dispute, parties agree to attempt amicable resolution for at least 30 days.

For Belgian consumers: disputes may be submitted free of charge to the Consumer Mediation Service (Service de Médiation pour le Consommateur):

For EU consumers: per Directives 2013/11/EU and Regulation (EU) 524/2013, consumer complaints may be addressed to the European Online Dispute Resolution platform (ODR): https://ec.europa.eu/consumers/odr/

Competent jurisdiction: absent amicable resolution, disputes shall be submitted non-exclusively to the courts of the judicial district of Brussels per Regulation (EU) 1215/2012.

15 Indemnification

Users indemnify and hold harmless MOLDEREZ-CONSULT from any claims, proceedings, judgments, or damages arising from: User breach of these Terms or applicable law; inappropriate or abusive platform use; User-uploaded Content, especially illegal, offensive, or infringing content; acts of minor Members under User supervision; third-party claims alleging rights violations from User Content.

16 Assignment and Contract Modifications

MOLDEREZ-CONSULT may assign or transfer all or part of its rights and obligations to subsidiaries, partners, or acquirers, provided it notifies the User. Users may cancel free of charge within 30 days of notice of a material assignment affecting their rights. Users may not assign, transfer, or sublicense their account without prior written consent from MOLDEREZ-CONSULT. Unauthorized transfer violates these Terms.

17 Severability and Entire Agreement

If any provision is found invalid or unenforceable, it shall be removed and others remain in force. Parties agree to work together to replace any invalid provision with a valid one having similar economic effect. These Terms and the Privacy Policy constitute the entire and exclusive agreement regarding platform access and use.

18 Governing Law and Jurisdiction

These Terms are governed by Belgian law without application of its conflict-of-law principles. The UN Convention on International Sale of Goods does not apply.

For disputes, absent amicable resolution (see Mediation section), parties submit exclusively to courts of the judicial district of Brussels per Regulation (EU) 1215/2012. For EU consumers, protection under mandatory national law is expressly preserved.

19 Amendments to Terms

MOLDEREZ-CONSULT reserves the right to modify these Terms. Substantial changes will be notified by registered email or in-app notification at least 30 days before taking effect, per Belgian Economic Code Article VI.51.

Continued use after 30 days constitutes tacit acceptance. Users who reject modifications may cancel free of charge without penalty through the effective date. Modifications are not retroactive and do not reduce rights for already-paid periods.
